Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and CarbonApps LLC ("Company," "we," "us," or "our"), governing your access to and use of the JournalistDB website at journalistdb.com and all related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

JournalistDB is a journalist contact database platform that provides users with access to journalist profiles, contact information, publication data, and related search and export tools. The Service includes both free and paid subscription tiers.

3. Account Registration

To access certain features of the Service, you must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete registration information
  • Maintain and update your information to keep it accurate and current
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

4. Subscriptions and Billing

Plans. The Service offers the following paid subscription plans:

  • Pro Monthly: $79 per month, billed monthly
  • Pro Annual: $399 per year, billed annually

Billing. Subscription fees are charged in advance on a recurring basis (monthly or annually, depending on your plan). All payments are processed through Stripe. You authorize us to charge the payment method on file for all applicable fees.

Cancellation. You may cancel your subscription at any time through your dashboard or by contacting support. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

Price Changes. We reserve the right to modify subscription pricing with 30 days' advance notice. Price changes will take effect at the start of your next billing cycle.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Service for sending unsolicited bulk email (spam) or in violation of CAN-SPAM, GDPR, or similar laws
  • Harvest, scrape, or systematically download data from the Service beyond normal use of the export feature
  • Resell, redistribute, or sublicense the data obtained through the Service
  • Use the Service to harass, stalk, or threaten any journalist or individual
  • Attempt to gain unauthorized access to any portion of the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Use automated scripts, bots, or crawlers to access the Service
  • Share account credentials with third parties or use a single account for multiple users

6. Data Usage and Accuracy

No Guarantee of Accuracy. While we make reasonable efforts to maintain accurate and up-to-date journalist contact information, we do not guarantee the accuracy, completeness, or timeliness of any data provided through the Service. Contact information may change without notice.

Your Responsibility. You are solely responsible for your use of the data obtained through the Service, including compliance with all applicable laws regarding email marketing, data protection, and communications.

7. Intellectual Property

The Service, including its design, features, content, and underlying technology, is owned by CarbonApps LLC and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service in accordance with these Terms.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARBONAPPS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Indemnification

You agree to indemnify and hold harmless CarbonApps LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including attorney's fees) arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we determine violates these Terms, is harmful to other users or the Service, or for any other reason at our sole discretion.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any legal action or proceeding relating to these Terms shall be brought exclusively in the federal or state courts located in Delaware.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Service with a revised "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.
